LEGAL NOTICE OF HEARING AS TO ANNEXATION AND ZONING REQUEST

FOR THE PROPERTY OF HARRISON AND JOAN KINNEY LOCATED WITHIN CLERMONT, GEORGIA

Notice is given that the Mayor and Council of Clermont, Georgia shall conduct a public hearing as to the application of Harrison and Joan Kinney to annex and bring within the corporate limits of the Town of Clermont, Georgia all that tract or parcel of land owned by Harrison and Joan Kinney and which is located within the unincorporated area of Hall County, Georgia. The property has a zoning classification of Agricultural Residential IV (AR-IV) under the Hall County Zoning Ordinance. The property will have a zoning classification of Agricultural Residential IV (AR-IV) under the Clermont Zoning Ordinance upon annexation. The Clermont Planning Commission will have a public meeting allowing public comment on November 12, 2024 at 7:00 p.m. at 639 Main Street, Clermont, Georgia. The public hearing by the Clermont Council will be held at 639 Main Street Clermont, Georgia, at 7:00 p.m. on December 3, 2024, and with the zoning ordinance entitled as follows:

AN ORDINANCE AMENDING THE ZONING MAP OF THE TOWN OF CLERMONT, GEORGIA, BY REZONING ALL THAT TRACT OR PARCEL OF LAND OWNED BY HARRISON AND JOAN KINNEY, AND BEING ALL THOSE LOTS OR PARCELS OF LAND LOCATED IN LAND LOT 33 OF THE 12TH LAND DISTRICT OF HALL COUNTY, GEORGIA AND BEING HALL COUNTY TAX PARCEL NUMBER 12033 000014, AND BEING MORE PARTICULARLY DESCRIBED ON A DEED OR PLAT WHICH IS ATTACHED HERETO AND, WHICH IS INCORPORATED BY REFERENCE INTO THIS ORDINANCE, AT THE TIME OF ANNEXATION AS AGRICULTURAL RESIDENTIAL IV DISTRICT (AR-IV) UNDER THE CLERMONT ZONING ORDINANCE [AND CURRENTLY ZONED PRIOR TO ANNEXATION AS AGRICULTURAL RESIDENTIAL DISTRICT IV (AR-IV) UNDER THE HALL COUNTY ZONING ORDINANCE], WITHOUT CONDITIONS; REPEALING CONFLICTING ORDINANCES; TO PROVIDE FOR SEVERABILITY; TO PROVIDE FOR AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.

A copy of the annexation petition, the plat for the property, and the Clermont Annexation and Zoning Ordinances are available for inspection at the City Hall at Clermont, Georgia. You are invited to attend the public hearing of the Town Council and give comments as to the proposed annexation and zoning. The Town Council shall take action on the annexation and zoning applications at the public meeting of the Town Council to be held at the same location and on the same date, immediately following the zoning hearing.

LEGAL NOTICE OF HEARING AS TO ZONING REQUEST

CONCERNING VARIANCE FOR THE PROPERTY OF CDI PROPERTIES, LLC LOCATED WITHIN CLERMONT, GEORGIA

            Notice is given that the Clermont Planning Commission will hold a public meeting allowing public input at the Clermont Chattahoochee Center on October 22, 2024 at 7:00 pm and the Mayor and Council of Clermont, Georgia shall conduct a public hearing as to the application of CDI Properties, LLC to amend the zoning map of the Town of Clermont, Georgia, in order to have a side setback variance granted to one tract of land owned by CDI Properties, LLC and which is located within the limits of the Town of Clermont, Georgia, and which currently has a zoning classification of Highway Business (HB). The public hearing will be held at the Clermont Chattahoochee Center, 639 Main Street Clermont, Georgia, at 7:00 p.m. on November 7, 2024 and with the variance ordinance entitled as follows:

AN ORDINANCE AMENDING THE ZONING MAP OF THE TOWN OF CLERMONT, GEORGIA, BY GRANTING A SIDE SETBACK VARIANCE STARTING AT 28 FEET AND GOING DOWN TO 8 FEET TO ALLOW A STORAGE BUILDING TO BE LOCATED ON THAT LOT DESIGNATED AS TAX MAP PARCEL # 12063 000057 WITHIN THE TOWN OF CLERMONT, GEORGIA, AND OWNED CURRENTLY OR FORMERLY BY CDI PROPERTIES, LLC, AND BEING MORE PARTICULARLY DESCRIBED ON PLATS OR DEEDS, WHICH ARE ATTACHED HERETO AND, WHICH ARE INCORPORATED BY REFERENCE INTO THIS ORDINANCE, AND PROVIDING THAT THE ZONING CLASSIFICATION UPON SAID PROPERTY SHALL BE SUBJECT TO A CERTAIN VARIANCE; REPEALING CONFLICTING ORDINANCES TO THE EXTENT OF THE CONFLICT; TO PROVIDE FOR SEVERABILITY; TO PROVIDE FOR AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.

            A copy of the variance request, the plat for the property, and the Clermont Zoning Ordinance are available for inspection at the City Hall at Clermont, Georgia.  You are invited to attend the public meeting and the public hearing and give comments as to the proposed variance to the zoning map.  The Town Council shall take action on the variance application at the public meeting of the Town Council to be held at the same location and on the same date, immediately following the zoning hearing.
